Terms of Service

Welcome to The Tribe of Giants. These Terms of Service (“Terms”) are a binding agreement between you and Mandelbrot Productions LLC, a Utah limited liability company that operates The Tribe of Giants at tribeofgiants.com (the “Service”). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
1. Who can use the Service
You must be at least 18 years old to create an account or use the Service. By using the Service, you represent that you are 18 or older, that the information you provide is accurate, and that you will keep it up to date. The Service is not directed to children.
2. Your account
You are responsible for your account and for keeping your login credentials secure. You are responsible for all activity that happens under your account. Tell us promptly at mandelbrotllc@gmail.comif you suspect unauthorized use. You may not share, sell, or transfer your account, and you may not create an account using another person’s identity.
3. What the Service is
The Tribe of Giants offers guided personal-growth journeys, community features, and AI-assisted guidance created by Nicholas Townsend Smith. The first journey (“Journey 1”) is available free; the remaining journeys and certain features require an active paid subscription. We may add, change, or remove features at any time.
4. Subscriptions, billing & cancellation
Paid access is sold as an automatically-renewing subscription billed through our payment processor, Stripe. When you subscribe you expressly authorize us and Stripe to charge your payment method the stated price on a recurring basis (for example, monthly) until you cancel. The price, billing interval, and renewal terms are shown to you before you check out.
You can cancel at any time from your account, with no cancellation fee. Cancellation stops future renewals; your paid access continues through the end of the period you already paid for. Full details — including our refund policy — are in our Billing & Refund Policy, which is part of these Terms. We may change prices with advance notice; changes apply to your next billing cycle.
5. AI features
The Service includes AI-assisted features, including “Rimi,” an AI guide. Your use of these features is also governed by our AI Usage Policy. AI output can be inaccurate or incomplete and is not professional advice. You are responsible for how you use it.
6. Your content and the license you give us
The Service lets you write reflections and notes, build a profile, send private messages, and post to the members’ community feed (“Your Content”). You keep ownership of Your Content. By posting or submitting it, you grant us a worldwide, non-exclusive, royalty-free license to host, store, display, reproduce, and distribute Your Content solely to operate, provide, secure, and improve the Service. This license ends when you delete the content or your account, except for content others have already re-shared and for backup copies kept for a limited time.
You represent that you have the rights to post Your Content and that it does not violate these Terms or our Community & Acceptable Use Policy. Your private reflections and notes are treated as private to you as described in our Privacy Policy; anything you post to the community feed or send in a message is visible to its recipients and should not be treated as confidential.
7. Acceptable use
You agree to follow our Community & Acceptable Use Policy. In short: don’t break the law, harass or harm others, post infringing or harmful content, attempt to breach security, scrape or overload the Service, reverse-engineer it, or resell or redistribute its content. We may remove content and suspend or terminate accounts that violate these Terms.
8. Our intellectual property
The Service and its content — the journeys, stories, songs, frameworks, text, graphics, software, and the The Tribe of Giants name and logos — are owned by Mandelbrot Productions LLC or Nicholas Townsend Smith and are protected by intellectual property laws. We grant you a personal, limited, non-transferable, non-exclusive, revocable license to access and use the Service for your own personal growth while your account is in good standing. You may not copy, sell, sublicense, publicly perform, or create derivative works from our content except as expressly allowed.
9. Third-party links, products & affiliate relationships
The Service may link to third-party sites and products (for example, books on Amazon). We do not control and are not responsible for third-party content or services. Some links are affiliate links, meaning we may earn a commission if you purchase — at no extra cost to you. See our Disclaimers for details.
10. Wellbeing & no professional advice
The Service is for education and personal growth only. It is not therapy, counseling, coaching-as-treatment, or medical, mental-health, legal, or financial advice, and it is not a substitute for care from a qualified professional. Results are not guaranteed and vary from person to person. See our Disclaimers for the full notice.

11. Disclaimers and limitation of liability
The Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any result will be achieved.
To the maximum extent permitted by law, Mandelbrot Productions LLC, Nicholas Townsend Smith, and our affiliates and vendors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, or goodwill, arising out of or relating to the Service. Our total liability for any claim relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the event giving rise to the claim, or (b) US $100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
12. Indemnification
You agree to indemnify and hold harmless Mandelbrot Productions LLC, Nicholas Townsend Smith, and our affiliates from any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising from Your Content, your use of the Service, or your violation of these Terms or of any law or third-party right.
13. Termination
You may stop using the Service and delete your account at any time in your settings. We may suspend or terminate your access if you violate these Terms, if required by law, or to protect the Service or its members. Sections that by their nature should survive termination (including content licenses already granted, IP, disclaimers, liability limits, indemnification, and dispute resolution) will survive.
14. Dispute resolution & arbitration
Please read this section carefully — it affects your legal rights. Except where prohibited by law, you and Mandelbrot Productions LLC agree to resolve any dispute relating to the Service through binding individual arbitration, rather than in court, except that either party may bring a claim in small-claims court. Arbitration will be administered under the rules of a recognized arbitration provider, and judgment on the award may be entered in any court with jurisdiction.
Class-action waiver: disputes will be conducted only on an individual basis and not as a class, consolidated, or representative action. 30-day opt-out: you may opt out of this arbitration agreement by emailing mandelbrotllc@gmail.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration. Nothing here prevents either party from seeking injunctive relief for intellectual-property or unauthorized-access claims.
15. Governing law
These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-law rules. Subject to the arbitration agreement above, any permitted court action must be brought in the state or federal courts located in Utah, and you consent to their jurisdiction.
16. Changes to these Terms
We may update these Terms. When we make material changes, we will update the date above and, where appropriate, notify you. Your continued use of the Service after changes take effect means you accept the updated Terms.
17. General
These Terms, together with the policies they link to, are the entire agreement between you and us about the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them to a successor.
